LicenSingOnline Terms of Use

1. ACCEPTANCE OF TERMS

Welcome to LicenSing™, a service of International Christian Resources LLC (ICR). ICR provides this service to you, subject to the following Terms of Use ("TOU"), which we may update from time to time. You can review the most current version of the TOU at any time at LicenSingOnline.org. ICR may also offer other web-based services from time to time that are governed by different Terms of Use. The following TOU apply only to LicenSing™.

2. DESCRIPTION OF SERVICE

LicenSing™ provides users with a license to copy and use the music of participating publishers and copyright holders in the life and work of their faith community. ICR has the right to change or discontinue any aspect of LicenSing™ at any time. For example, we may change the price, content, hours of availability or equipment needed for access or use.

3. CONTENT AND USE

Your LicenSing™ license allows you the legal right to reprint music that is owned or controlled by copyright holders and publishers represented by LicenSing™. Please refer to our Partner Page for a complete list of copyright holders represented. You are responsible for all license fees and requirements.

The right to reprint copyrighted music, as provided by your LicenSing™ license, is intended for noncommercial use only. Any other use, including the creation of custom hymnals or songbooks for your organization, is strictly prohibited.

4. GUIDE TO COPYRIGHT

A copyright is intellectual property that belongs to a copyright holder. Only the copyright holder or administrator of that copyright has the legal right to use or to grant permission to use the copyrighted material. Pursuant to your LicenSing™ license, you agree to comply with the following:

  • Unless otherwise specified, licenses are for a specified period of time and cover the life of the original quantity printed during the term of your license; if you wish to reprint additional copies or use existing copies following expiration of your license, you must obtain a new license.
  • Licensees are asked to discard any remaining printed material covered by the license at the end of the designated time period shown on the license.
  • Licenses are issued for words and melody line only unless otherwise stated.
  • Music and text may not be changed from the copyrighted material.
  • The title and name(s) of the composer(s) along with the appropriate copyright notice must appear on each copy of each song.
  • A license is issued with the understanding that it may be used only by the church or individual that has purchased it. Reprints are not intended for re-sale.
  • Churches, schools, and non-profit organizations are not exempt from copyright law.

5. ACCOUNT INFORMATION

To use LicenSing™ you must establish a LicenSing™ account using an email address. By establishing your account, you agree to (a) provide true, accurate, current and complete information about yourself ("Account Information") and (b) maintain and promptly update your account should the information change.

6. ACCOUNT ACCESS AND SECURITY

Each time you access LicenSing™ you must enter your email address and the password associated with your Account Information. You are responsible for maintaining the confidentiality of your email address/password, and are fully responsible for all activities that occur under your email address/password. You also agree to immediately notify ICR of any unauthorized use of your email address/password or any other breach of security. ICR cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

7. PRIVACY POLICY

Account and personal information are subject to the Privacy Policy of LicenSingOnline.org. For more information, see our full Privacy Policy.

8. COMMUNICATIONS WITH SUBSCRIBERS

ICR reserves the right to send electronic mail to you regarding LicenSing™ and related information.

ICR may contact you via e-mail regarding your participation in user surveys, asking for feedback on LicenSing™ and/or existing or prospective products and services. This information will be used to improve LicenSing™ and to better serve our users. All correspondence regarding LicenSing™ should be sent to info@LicenSingOnline.org.

9. FINANCIAL RESPONSIBILITY

You agree not to assign, transfer or sublicense your rights as a subscriber to LicenSing™. If you have purchased as a member of a church or institution, you agree not to assign, transfer or sublicense your rights as a subscriber to LicenSing™ to anyone outside of your church or institution. You agree to be financially responsible for all usage or activity on your LicenSing™ account.

10. NO RESALE OR COMMERCIAL USE OF SERVICE

You agree not to sell, resell or offer for any commercial purpose any portion of LicenSing™, use of LicenSing™ or access to LicenSing.™ This includes, but is not limited to, the creation of custom hymnals or songbooks for your organization.

11. EQUIPMENT

You shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of LicenSing™ and all charges related thereto.

12. MONITORING

ICR shall have the right, but not the obligation, to monitor the content of LicenSing™. ICR shall have the sole right to edit, or remove any material on the website.

13. CHANGED TERMS

ICR shall have the right to change or modify these Terms of Use at any time. Such changes or additions shall be effective immediately upon posting on LicenSingOnline.org or when you obtain actual knowledge of them. Any use of LicenSing™ after such notice shall constitute your acceptance of such changes and/or additions.

14. TERMINATION

You may terminate your license at any time by sending an e-mail to info@LicenSingOnline.org or by calling your sales representative. Upon termination, you agree to immediately discontinue use of and destroy all copies made while the license was in effect.

You will remain liable for the full cost of licenses purchased for terms of less than one year. Therefore, we will not refund the purchase price of 1, 2, 4, 6, or 8 week licenses.

We do, however, offer a pro-rata refund of the annual license fee. The refund amount will be based on the remaining license term, rounded to the next whole month, as calculated from the effective date of the license to the termination date. All refunds will be processed within 30 days from date of termination.

ICR may, in its sole discretion, terminate or suspend your access to all or part of LicenSing™ for any reason.

15. GOVERNING LAWS AND JURISDICTION

These Terms of Use shall be governed by and interpreted according to the laws of the State of Oregon. You consent to jurisdiction in the State of Oregon, and you agree that Multnomah County, Oregon, shall be the venue for any action brought under these Terms of Use.
